Your request for the lease of Man Made Hill is refused under section 7(2)(b)(ii) of the LGOIMA on the grounds that withholding this information is necessary to protect information where the making available of the information would be likely unreasonably to prejudice the commercial position of the person who supplied or who is the subject of the information.

As part of negotiated changes several years ago to the leasing arrangements between the Council and the Ben Ohau Golf Club, which included the golf club surrendering large areas of land back to Council, the lease and sublease for the area containing the Spark (now Connexa) tower were altered.
That tower area is now subject to a lease between the Council and the Ben Ohau Golf Club. The golf club then sub-leases that area to Connexa.
Your request for the lease of Man Made Hill is also refused, under section 7(2)(h) of the LGOIMA to enable any local authority holding the information to carry out, without prejudice or disadvantage, commercial activities.
