Proposed Plan Change 23, 24, 25, 26 and 27

Pursuant to Clause 5 of the First Schedule of the Resource Management Act 1991, the Mackenzie District Council (the Council) gives public notice of proposed Plan Changes 23 to 27 to the Mackenzie District Plan.

Proposed Plan Changes 23 to 27 form Stage 3 of the review of the Mackenzie District Plan and have been drafted in accordance with the National Planning Standards.

All changes promoted in Plan Changes 23 to 27 are to the operative Mackenzie District Plan, which is in the process of being transferred to an EPlan format. This public notice identifies which parts of the Plan can be viewed in the EPlan format.

Plan Change 23

Plan Change 23 proposes to add the following chapters to the Mackenzie District Plan:

Part 2 – District Wide Matters
  • Natural Environmental Values
    • Natural Character (NATC)
    • Natural Features and Landscapes (NFL)
Part 3 – Area Specific Matters
  • Zones
    • Rural Zones
      • General Rural Zone (GRUZ) – including a new ‘Takamana / Lake Alexandrina Hut Settlements Precinct’ (PREC3)

Plan Change 23 also proposes to amend (in part) the following sections of the Mackenzie District Plan and to delete Appendix E, M, R and V:

E Plan

Part 1 – Introduction and General Provisions
  • Interpretation
    • Definitions
Part 4 – Appendices and Maps
  • Remove the Rural Zone and rezone this land General Rural Zone (GRUZ);
  • Identify a new Specific Control Area 13 (Eastern Plains);
  • Identify the three areas of Takamana / Lake Alexandrina Hut Settlement as set out in Appendix 5, as PREC3, and remove these areas from Te Manahuna / the Mackenzie Basin ONL and Lakeside Protection Area Overlays;
  • Identify new Wilding Control Removal and Wilding Conifer Management Overlays;
  • Remove the Opuha Dam Special Purpose Zone and include that land within the GRUZ and Specific Control Area 13 (Eastern Plains);
  • Rezone the land on Talbots Road south of the Fairlie Golf Club (currently zoned Industrial) to GRUZ and include within Specific Control Area 13 (Eastern Plains), as set out in Appendix 6;
  • Include new Outstanding Natural Features, Outstanding Natural Landscapes and Geopreservation sites as identified by the Eastern Mackenzie Landscape Study;
  • Amend the existing Te Manahuna / Mackenzie Basin ONL to include the western extent of the District; and
  • Amend existing Farm Base Areas, as set out in Appendix 7.1.7.
  • Make consequential amendments to the Te Manahuna / Mackenzie Basin Outstanding Natural Landscape Overlay to remove it from the following Special Purpose Zones/Zoned areas:
    • Tekapo Industrial Zone
    • Pukaki Village Zone
    • Airport Zones at Tekapo, Pukaki and Glentanner;
    • Open Space G (Glentanner)
    • Pukaki Downs Tourist Zone

Plan Change 24  

Plan Change 24 proposes to add the following chapter to the Mackenzie District Plan:

  • Historical and Cultural Values
    • Sites and Areas of Significance to Māori (SASM)

The rules in the SASM chapter will have immediate legal effect from the date of notification of this plan change, pursuant to s86B(3)(d) Resource Management Act 1991.

Plan Change 24 also proposes to amend (in part) the following sections of the Mackenzie District Plan:

  • Remove the Rural Residential Zone Manuka Terrace and rezone this land Rural Lifestyle Zone;
  • Remove the Ōhau River Rural Residential Zone and rezone this land Rural Lifestyle Zone and insert the Ōhau River Precinct (PREC4) on this land;
  • Rezone Rural Zoned land at Clayton Road and Nixons Road, Fairlie Rural Lifestyle Zone;
  • Insert a new Specific Control Area 9 to identify the Nixons Road Specific Control Area;
  • Insert a new Specific Control Area 10 to identify the Clayton Road Specific Control Area;

  • Amend the Planning Maps to identify 33kV electricity distribution lines and 110kV, 220kV, or 350kV national grid transmission lines.

Plan Change 27

Plan Change 27 proposes to add the following chapters to the Mackenzie District Plan:

  • Natural Environmental Values
    • Public Access (PA)
  • Subdivision (SUB)
  • General District Wide Matters
    • Earthworks (EW)

Two rules in the Subdivision chapter will have immediate legal effect. These are Rules SUB-R9 and SUB-R12 that relate to subdivision of a site containing a heritage item listed in the Heritage items Schedule, and subdivision within SASM Schedule 2 Silent File or Schedule 3 the Māori Rock Art Protection Area.

Plan Change 27 also proposes to amend (in part) the following sections of the Mackenzie District Plan and to delete Section 15 – Transportation, Appendix C and Appendix D:

The changes promoted by Plan Changes 23 to 27 are within the scope of Plan Changes 23 to 27, and changes to other provisions (including maps) of the Mackenzie District Plan are not within the scope of Plan Changes 23 to 27. It should also be noted that the general premise of the District Plan review is to not change the key objectives, policies and rules arising from Plan Change 13 (PC13), which primarily apply to Te Manahuna / the Mackenzie Basin Outstanding Natural Landscape (ONL). These provisions have been integrated into the new NFL District Wide Chapter consistent with the National Planning Standards but are otherwise beyond the scope of Plan Changes 23.

Submissions

Any person may make a submission on proposed Plan Changes 23 to 27. Where a person can gain advantage in trade competition through a submission, then the person may only do so if the person is directly affected by an effect of the Plan Change that adversely affects the environment; and does not relate to trade competition or the effects of trade competition.

Lets Talk - District Plan Review Stage 3

Submissions must be in the format prescribed by Form 5 and must state whether or not you wish to be heard on your submission. Paper submission forms are available at the Council Offices in Fairlie and Twizel.

The closing date for lodging a submission is Friday 26 January at 5.00pm.

Once the closing date for submissions has passed, Council will publicly notify all submissions received, prepare a summary of submissions, and will allow a period for further submissions in support of, or in opposition to, those submissions already made.

Council hearings for Plan Changes 23 to 27 will then be arranged to consider all submissions. Anyone who has made a submission and indicated that they wish to be heard will have the right to attend the hearings and present their submission.

Any person who has made a submission has the right to appeal against the decision on the Plan Changes to the Environment Court if in relation to a provision or matter that is the subject of the appeal, the person referred to the provision or matter in the person’s submission on the proposal.
